Artificial intelligence is rapidly reshaping innovation in optical sciences, but it is also raising complex legal and commercialization questions. This session will explore pathways for moving AI-driven discoveries from lab to market while navigating today’s evolving intellectual property landscape.

We will unpack what is actually patentable when AI is involved, including the role of human inventorship and how AI-assisted inventions are being evaluated. The discussion will also provide an update on current developments at the U.S. Patent and Trademark Office (USPTO), including guidance on AI-related patents and examination practices. We’ll examine real-world examples of valid vs. non-valid inventions, highlighting common pitfalls in patent eligibility from abstract claims to insufficient human contribution. Finally, an optics tech example from start to finish will illustrate how AI-assisted disclosures and inventions with AI features are patentable if prepped correctly, and what the trends look like.
